El federalismo es un método: construir el todo desde la parte. . Pero, también, un espíritu: el que fundamenta el principio de subsidiariedad. . Un federalismo desde abajo, que reconoce y respeta la diferencia, que articula de maneras diversas las realidades que son diversas. Un federalismo que se basa en dos columnas: la igualación en servicios y estándares de vida de los ciudadanos de todas las partes federadas; es decir, que es solidario con las partes menos desarrolladas. Pero un federalismo que no confunde la solidaridad con la uniformidad. . Nuestra propuesta federal quiere convencer a España que su pluralidad es su gran riqueza: no es su problema, es la solución de su problema. Y es la llave de su identidad futura. ¿Es que Gran Bretaña y Estados Unidos, por ejemplo, no tienen diversidad? La tienen. Y Gran Bretaña -aunque no se llame federal - está haciendo devolución de poderes a sus territorios singulares. . ¿Qué significa contribuir a la construcción de la España plural? ¿Qué quiere decir en definitiva, aquí y ahora, la España federal que proponemos? �2 . ¿Qué diferencias hay entre nuestra propuesta federal y lo que proponen los nacionalistas? El nacionalismo catalán empieza la Declaración de Barcelona diciendo: Puesto que todo ha ido mal, vamos a cambiarlo. Y nosotros empezamos diciendo: Puesto que todo ha ido bastante bien, podemos ir más lejos. Se trata de discutir no de dinero y poder, sino de objetivos compartidos, que se refieren al dinero, que se refieren al poder, que se refieren al Senado, que se refieren a la justicia y que se refieren a la cultura. Y esos objetivos se pueden compartir. . La España plural significa: Federalismo fiscal • Que Catalunya, y las otras comunidades autónomas del artículo 151 de la Constitución en proporción a sus competencias, obtengan los mismos resultados en gasto público por habitante que Euskadi. En un horizonte de un máximo de 20 años. Hemos dicho los mismos resultados, no necesariamente el mismo procedimiento. • Que el Estado llegue el año 2005 a una distribución del gasto público más favorable a los ayuntamientos, a la proximidad y a la sociedad civil, limitando su participación - sin pensiones ni amortizaciones de deuda pública - al 40% , y �3 • Que el Estado invierta la misma cantidad de capital por habitante en las áreas metropolitanas españolas de más de un millón de habitantes. Hoy Madrid, Barcelona y Valencia, y en un futuro extender la igualación a otras ciudades del grupo de las siete grandes (Sevilla, Bilbao, Zaragoza y Málaga). • Que las autonomías paguen en proporción a su riqueza y reciban en proporción a su población. . Nos parece desde Catalunya que este es un objetivo que se puede asumir. Tiene la virtud de insistir en la cohesión y la virtud adicional de limitar el esfuerzo en el tiempo. Está en la línea de la reciente sentencia del Tribunal Constitucional alemán para la cohesión entre los territorios ricos y pobres de la República federal y en la línea del consejo europeo respecto a la cohesión entre naciones o estados. . Lo que ha de quedar claro es que nuestra propuesta federal desde el punto de vista fiscal insiste en tres cosas: . Que lo importante no es discutir solamente qué impuestos concretos y qué gasto concreto se redistribuye (La fórmula Zaplana, que parece aceptada por los nacionalistas catalanes, es bastante parecida a la que ya avanzamos nosotros el año 1996: insistir en los impuestos indirectos y no sólo en el impuesto sobre la renta). Lo importante es ponerse de acuerdo en los objetivos que perseguimos. �4 . Que el federalismo fiscal no es auténtico federalismo si no comporta un cierto margen de libertad en el establecimiento de los tipos impositivos - cosa que puede aligerar también los problemas derivados de la mayor demanda de servicios de la población a medida que aumenta la renta y que de paso garantiza la única corresponsabilidad fiscal de las autonomías. Hoy ausente. . Que la discusión sobre los objetivos del federalismo fiscal no se puede ir retardando hasta finales de 2001, tal como está previsto, para entrar en vigor el 2002. Esto supondría, contando con los plazos de entrada en vigor efectivo del sistema, que no se aplicaría totalmente hasta la siguiente legislatura. Esto introduce un grado de incertidumbre política inaceptable. Los socialistas catalanes proponemos que la discusión empiece ahora, que en ella seamos todos y que en el plazo de un año se hayan fijado unos objetivos estables para los próximos años. . En resumen: los catalanes ofrecemos un cuadro estable de relaciones fiscales y financieras de carácter federal, equitativos, duraderos, corresponsables y suficientes para eliminar los fantasmas del rencor y de la desconfianza entre comunidades. . De otra manera, iríamos empujando hacia el futuro los problemas del presente sin resolverlos del todo. Si España ha resuelto en los últimos 20 años buena parte de las cuestiones pendientes desde el 98 del siglo XIX, ahora ha de resolver éste. �5 . Pero España también ha de resolver lo que nosotros llamamos federalismo cultural, judicial y político. Ahora, veinte años después de la Constitución, ha llegado el momento de proclamar algo que la propia Constitución podía reconocer genéricamente pero no específicamente, porque las autonomías todavía no existían. Federalismo cultural . En el terreno cultural y simbólico planteamos el tema desde los principios de siempre. Y en cultura los principios son el reconocimiento de la existencia de idiomas, de derechos, de culturas diversas en este país, y la necesidad de que el Estado, que por Constitución tiene la obligación de hacerlo, los proteja. . Los cuatro idiomas españoles, el castellano, el catalán, el vasco y el gallego, han de estar protegidos por el Estado y estar presentes en sellos, pasaportes y documentos de identidad, en las emisiones del euro y en las instituciones culturales españolas de todo tipo. . De la misma manera, Catalunya defenderá y protegerá el castellano como una inmensa riqueza propia, cerrando así el largo período histórico de justificado resentimiento por la continuada persecución del catalán e imposición del castellano, que duró dos siglos. . Por otra parte, es imprescindible que en todas las escuelas de España se explique una historia que sea �6 la Historia Común de los Pueblos de España, que no es lo mismo que la Historia única - o común - de España (tema éste muy de actualidad). . ¿Qué quiere decir la Historia Común de los Pueblos de España? Quiere decir que hay una historia específica de cada nacionalidad o región que nos atañe a todos y que para que las nuevas generaciones se formen en la realidad plural de España han de conocer también los grandes rasgos de estas diferentes historias, que en definitiva es la historia común de todos. A modo de ejemplo, en el resto de España han de conocer qué pasó el 11 de setiembre de 1714 en Catalunya para entender qué pasa ahora el 11 de setiembre en Catalunya. Y así iríamos siguiendo con las respectivas especificidades. . ¿Y por qué este empeño? Porque la educación es la fuente del entendimiento, y el entendimiento es el cimiento de la España plural, el único cimiento duradero. . Federalismo es también esto: educación en la pluralidad. Y en el reconocimiento por parte del Estado de la existencia en su seno de realidades diferentes que la Constitución proclama, pero que no enumera. No las denomina porque las comunidades autónomas llegaron después y por tanto, cuando la constitución dice "España tiene nacionalidades históricas y regiones" luego no dice cuáles son. Y no es fácil de decir, porque antes hemos hablado de tres, pero Aragón en su estatuto tiene lo que es, ¿y quién duda que la Corona de Aragón es histórica? Y Valencia podría decir lo mismo. ¿Y quién duda de que la insularidad es un �7 elemento de diferencia - geográfica en este caso enormemente importante? . Por tanto, ¿qué tiene qué hacer el Estado? No tiene que quedarse atado por una Constitución que no lo ata. Federalismo judicial . En el campo judicial, los socialistas catalanes estamos por la transferencia a los Tribunales Superiores de Justicia de las competencias del Tribunal supremo en materia de casación de sentencias. Este es uno de los aspectos de la necesaria reforma, agilizacion y acercamiento de la justicia al ciudadano. . Entendemos que la casación en los Tribunales Superiores autonómicos ha de tener una excepción. Por ejemplo, si un ciudadano gallego obtiene una sentencia más favorable que un ciudadano catalán en las mismas circunstancias, este último puede recorrer a Tribunal Supremo español pidiendo el mismo trato. Federalismo político . Finalmente, el principal objetivo de la propuesta catalana en materia política es la conversión del Senado en lo que el artículo 69.1 de la Constitución proclama: la cámara de los territorios. También como es conocido, la necesidad y la factibilidad de que instituciones del Estado se radiquen en Catalunya, también, por su especificidad, en otras nacionalidades o regiones. �8 . La corrección efectuada por la Presidenta del Senado en su inicial disposición a la reforma auténtica (para convertirla a la práctica en una mera reforma reglamentaria) se basa en el artificio de igualar a los territorios autónomos a los municipios y provincias a estos efectos. . Nuestra propuesta catalana apuesta por un Senado de los territorios según el modelo alemán. Un Senado decisivo en temas territoriales, forum habitual de la discusión de los objetivos de reparto fiscal y competencia, en el cual los presidentes autonómicos han de ser senadores natos y el resto de senadores representando los territorios y formando grupo territorial. He dicho grupo territorial, que no grupo político. . No estamos en contra, si no todo lo contrario, somos totalmente partidarios de la presencia de alcaldes-senadores en la representación autonómica correspondiente. Conclusión . Hasta aquí nuestra propuesta federal resumida en los cuatro puntos que he mencionado. . ¿Para llevarla a cabo, hemos de reformar la Constitución? Esta expresión, "reformar", a veces sugiere lo que no es. En todo caso, lo que si hemos de acabar es con el tabú de la Constitución intocable. . Porque es reconocido, en el campo político y en el campo académico, el carácter abierto de nuestra �9 Constitución, que es el que ha permitido precisamente la construcción del Estado autonómico. . Un sistema complejo, como el Estado de las Autonomías, que aspire a mantenerse y a avanzar y modernizarse ha de ser abierto y adaptable. . El consenso de partida que hizo posible la Constitución de 1978 exige su continuidad a través de un pacto constitucional permanente o de su renovación periódica. . A nuestro entender, están fuera de la realidad las propuestas de cerrar el modelo de Estado y también las que consideran intocable la Constitución. Son actitudes que esconden la defensa de una España que ya no existe. . Porque una cosa es proponer el "cierre del modelo", como hace el PP, y otra muy distinta es querer dar nuevas perspectivas al Estado autonómico a partir de la corrección de sus disfunciones y de sus desequilibrios. . He dicho muchas veces que somos diversos y tenemos intereses comunes. Esta es una de las definiciones del federalismo y, en nuestro caso, de la España federal. . Y es a partir de ahí, de que somos diversos y de que tenemos intereses comunes que hemos de avanzar.
