Y sé que Josep M. Sala, privado de libertad, no perderá el tiempo. No se siente vencido. No quiere el indulto sino la absolución. Los que van a prisión convencidos de haber perdido la honorabilidad se sienten vencidos y purgan una pena doble, física y moral. No es el caso de Sala. No entro en la sentencia. Creo que el PSOE, como ha dicho Almunia, tiene que acatar la sentencia -aun estando disconforme con ella por desigual en relación con otras- y pedir excusas a su electorado. Y el PSC, como ha hecho Serra, también. La suposición acerca de si uno, PSC, paga por el otro, PSOE, aunque sea verdad que se trata de la financiación del PSOE, no es sino una más de las malicias de la ideología dominante en Cataluña. Típica. Esa mezcla de discreción y maniqueísmo: los culpables son siempre otros. Almunia dijo que eso no sólo no volvería a pasar sino que no estaba pasando ya desde hace tiempo. Es decir, que no funcionan ya aquellos inventos mal concebidos para dar legalidad (sin al final conseguirlo, además) a unas donaciones que de todos modos se hubieran producido y se han producido de hecho en la práctica política española, como ha señalado hace poco Enrique Lacalle y hace algo más Miguel Roca. Y que conste que la sinceridad les honra. Aportar dinero las empresas a los partidos, en sí, ni ha sido siempre delito ni está claro que lo vaya a ser y en qué casos y en qué condiciones, en el futuro. Los que temen por la desigualdad de acceso a los fondos empresariales tienden a imaginar soluciones públicas, más equitativas. Pero poco fiables, mal vistas por el público, dicen otros, como los radicales italianos que devuelven el dinero del Estado en las calles de Roma. Los políticos debemos crear la transparencia y las prácticas económicas y morales que harán que los jueces no tengan tantas dificultades para no equivocarse. Estamos hablando de la financiación ilegal de partidos políticos y no de delitos peores, como el enriquecimiento personal y la prevaricación. Aquí nadie se ha metido un duro en el bolsillo. No es como en el caso Estevill y Roldán. Ni como los casos Macosa, Rosillo, Roma, Torelló, Mas Blau o Sóller, que por cierto no han terminado en prisión. Sólo el bueno de Planasdemunt pagó por lo que fuera o por quien fuera. Algunos dijimos públicamente que ese caso era vergonzoso, por lo único. Los políticos, en cuanto legisladores, hemos de hacer todavía más: crear las normas de tal forma que su adecuación a la realidad social permita a los jueces su aplicación concreta que evite, en lo posible, la subjetividad; con lo que las situaciones imprevistas y extremas supuestos que no deben excluirse porque forman parte esencial del impartir justicia- deben quedar limitadas en lo máximo a los criterios interpretativos que las mismas normas prevén. Lo digo porque, aunque a distancia, he leído un artículo de un jurista ponderado que explica que los hechos relatados en el caso Filesa producen una horrorosa impresión de falta de respeto a las normas y que es tan extremo y nuevo el caso que se juzga, que incluso si la sentencia no es correcta, y aparentemente puede no serlo, según dice el autor, hay que ser condescendientes con los jueces. Este argumento impresiona mucho. Esta es la primera sentencia o casi que condena en serio lo que aparece como financiación ilegal de partidos políticos. Sorprende "a posteriori" que no se 111 de 204 �Articles de Pasqual Maragall a LA VANGUARDIA haya aplicado la misma firmeza a ninguno de los casos intuidos o conocidos de financiación ilegal en gran escala: Casinos, Naseiro, Inverbroker, De la Rosa, etc. Pero no debería sorprender; sí entristecer, pero no sorprender: empezar cuesta. Lo chocante es que si hay que ser condescendiente con los jueces si se equivocan en Filesa por demasiado, no se sea durísimo con ellos si se pasan por poco en los demás. Si lo que se quiere decir es que hay que aplaudir (o discretamente no criticar) a los que bien o mal se han atrevido por primera vez con un partido político, de acuerdo. Pero entonces seamos consecuentes porque si no la hipocresía reinará sin freno: digamos todos que somos "solidarios" con los primeros que han tenido que pasar por la prueba durísima de la privación de libertad durísima, aún si no tanto como se imaginan los que no pueden entender que Sala esté tranquilo, que no se sienta íntimamente condenado sino víctima de una debilidad ante el fraude que por algún lado tenía que romperse, y que se rompe, claro, por el menos fraudulento (si es que finalmente lo es el caso de Sala), por donde es más fácil. Hay que pedir a Pujol y Roca, a Aznar y Fernández Díaz, que no sólo expresen su simpatía personal por Sala y por Navarro y su malestar personal por lo que le sucede, sino que expresen su solidaridad con él, cosa muy distinta. Sala y Navarro van a prisión también por ellos. Más le conviene a todos agradecérselo que dejar crecer la víbora del resentimiento que sin duda está ya ahí cargada de razón. El cántaro se ha roto por ahí de tanto llevarlo a la fuente "todos".
